    Privacy

  1. Support Information Exchange Inc. ( hereinafter referred to as “SIX” ), does not automatically gather any personal information from you. This information is only obtained if you supply it voluntarily, usually through contacting us via e-mail, phone or regular postal service or registering in the demonstration and download portions of the site.
  2. Any personal information you do provide is protected under the Private Information Protection and Electronic Documents Act (“PIPEDA”). This means that, at the point of collection, you will be informed that your personal information is being collected, the purpose for which it is being collected and that you have a right of access to the information.
  3. We use software that receives and records the Internet Protocol (IP) address of the computer that has contacted our Web site. We make no attempt to link these addresses with the identity of individuals visiting our site.
  4. We do not regularly use "cookies" to track how our visitors use the site. Whenever we enable "cookies" to facilitate your transactions, we will first inform you.
  5. Compliance with Privacy and Confidentiality Obligations of Legal Professionals. The Common Law, regulations of applicable Law Societies and the statutory provisions of the Private Information Protection and Electronic Documents Act (“PIPEDA”) and its equivalent provincial legislation impose upon members of the legal profession an obligation to maintain the confidentiality of their client’s information and impose a high duty of care standard in the performance of this obligation.
  6. Model Code Requirements. The National Model Code for the Protection of Personal Information prescribed in Schedule 1 to PIPEDA contemplates that lawyers may put client confidential information into the hands of third parties for processing provided that the lawyer enters into contractual obligations to ensure that the client’s data is protected by the third part to the same standard imposed upon the lawyer.
  7. Best Practices Compliance. SIX permits members of the legal profession to use technology to observe the highest standard and best practices for the collection, retention, disclosure and transmission of client confidential information.
    • Client data is transmitted to the SIX servers in encrypted format.
    • Client data is retained on the SIX servers in encrypted format and can only be accessed through a password protected security code.
    • Passwords and security codes are transferred through a secured communication link.
    • SIX servers are dedicated resources owned by SIX. These are not shared resource or cloud based servers.
    • The SIX server and its backup server are physically located in Canada in a secure server facility with 24/7 staffing, physical (locked) security, video surveillance, access protection and password protected account access.
  8. Incident Reporting. As custodians of their client’s confidential information, lawyers have an obligation to promptly inform their clients of any breach of security over their client’s information and to advise their client as to what steps are being taken to remedy any such breach. In the unlikely event of a security breach affecting either the SIX servers or of any unauthorized access incident affecting client data stored on the SIX servers, SIX’s Chief Privacy Officer (as designated on our website) will promptly inform that lawyer who provided the client information of all known details of the incident together with all remedial steps being undertaken by SIX.
  9. If you are not satisfied with our response to your privacy concern, you may wish to contact the Office of the Privacy Commissioner.
  10. Security

  11. The SIX servers reside in a highly-secured facility with 24 x 7 x 365 uniformed security desk, CCTV cameras throughout, door entry-card access, a front door mantrap for controlled entry and limited, supervised access to all secured areas.
  12. Our servers are protected with firewalls and the latest internet security updates.
  13. When you log in to SIX your communications between your computer and the server are encrypted with 256-bit encryption, similar to the functionality used by banks and popular e-commerce services for secure communication.
  14. All documents are stored on our servers using a "salted" encryption method so that only you, your co-parent, and your related Family Law Practitioners (if applicable) are able to display the content of your documents.
  15. All document titles and descriptions are stored in the database in encrypted form.
  16. Each user has their own unique username and password, all passwords are hashed and stored in the SIX database so that not even SIX staff can view or determine a user's password.
  17. Liability

  18. The parties acknowledge and agree that SIX , its officers, directors, employees, legal counsel, agents or assigns does not provide legal representation, legal services or legal advice to any party who has registered with Support Information Exchange.com.
  19. The registrant hereby waives all rights , claims or actions of any kind whatsoever against SIX , its officers, directors, legal counsel , employees, agents or assigns arising out of any documentation, information, data entry or communications of any kind provided by the registrant or registrant’s opposite party to Support Information Exchange.com.
  20. The responsibility for documentation, information , data entry or communications of any kind supplied to Support Information Exchange.com is the sole responsibility of the party providing that information, and in particular, SIX assumes no responsibility for the accuracy of information provided to Support Information Exchange.com by any party.
  21. The parties shall provide active email addresses to Support Information Exchange.com upon registration and update those email addresses from time to time as changes occur. Losses, complaints, damages or causes arising out of the failure to maintain active email addresses with Support Information Exchange.com are the sole responsibility of the party who failed to maintain an active email address with Support information Exchange.com and the parties hereby waive and release any and all claims against SIX in respect of such failure.
  22. Legal Demand to Produce Client Information. Should SIX receive a legal demand to produce or preserve client information on its servers from a competent legal authority, it will immediately inform the lawyer having password access to the account. SIX has no ability to access client information stored on its servers in unencrypted form and accordingly cannot produce any client information whether under legal demand or court order.
  23. SIX shall not be requested to provide contact information , including, but not limited to, email addresses , addresses or phone numbers to the other party and shall at all times keep all such contact information confidential . The officers, directors, legal counsel, employees , agents or assigns of SIX shall not be compelled to provide such information to a court of competent jurisdiction.
  24. SIX and its officers, directors, legal counsel , employees, agents or assigns shall not be compelled to appear in court or provide evidence in court for any reason, and in particular, to provide copies of documentation, information , data entry or communications provided to Support Information Exchange.com by either party or provide any explanation of the ledger entries or contact information or facilitate service of court documents on one of the parties.
  25. SIX or its officers, directors, legal counsel , employees, agents or assigns shall not be subject to a court order for substitute service on any party.
  26. In the event that SIX or its officers, directors, legal counsel , employees, agents or assigns are compelled to appear in court or provide documentation to the parties, their counsel or agents, the party requesting or initiating the appearance shall pay the full amount of costs incurred by SIX inclusive of interest at the rate of 2% per annum over the TD Canada Trust prime business rate from time to time. SIX. shall have the right to recover such costs from such party’s credit card, bank account or such other pre-authorized payment method on file with SIX without further authorization or consent of such party.
  27. The parties hereby waive all rights, claims or actions of any kind whatsoever against Legal Aid Ontario, its officers, directors, legal counsel, employees, agents or assigns arising out of any documentation, information, data entry or communications of any kind provided by the parties to SIX.
  28. In the event of non-payment of a required fee both parties will be notified by email that the account is suspended until such time as the required payment(s) have been made.
  29. The parties agree to accept the terms of registration as may be amended from time to time.
  30. Acceptance Of This Agreement. Your access to and use of this website ("the Website") is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the website.
  31. Advice. The contents of the Website do not constitute advice and should not be relied upon in making or refraining from making, any decision.
  32. Changes to Website, Software, and Services. SIX reserves the right to:
    1. change or remove (temporarily or permanently) the Website or any part of it without notice and you confirm that SIX shall not be liable to you for any such change or removal.
    2. change, remove, or discontinue any software, service, or promotion (including but not limited to any previsions, parts thereof, licensing, pricing) as advertised on this website at any time without notice and you confirm that SIX shall not be liable for any such change or removal.
    3. change or discontinue any promotional discount vouchers or coupon codes at anytime with notice and you confirm that SIX shall not be liable for any such change or removal.
    4. change this Agreement at any time, and your continued use of the Website following any changes shall be deemed to be your acceptance of such change.
  33. Links to Third Party Websites. The Website may include links to third party websites that are controlled and maintained by others. Any link to other website is not an endorsement of such website and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
  34. Copyright. The Intellectual Property Rights in this website and the materials on or accessible via it belong to SIX or its licensors. This website and the materials on or accessible via it and the Intellectual Property Rights therein may not be copied, distributed, published, licensed, used or reproduced in any way (save to the extent strictly necessary for, and for the purposes of, accessing and using this website). SIX and the SIX Logo are trademarks which belong to SIX and they may not be used, copied or reproduced in any way without written consent from SIX. For these purposes "Intellectual Property Rights" includes the following (wherever and when ever arising and for the full term of each of them): any patent, trade mark, trade name, service mark, service name, design, design right, copyright, database right, moral rights, know how, trade secret and other confidential information, rights in the nature of any of these items in any country, rights in the nature of unfair competition rights and rights to sue for passing off or other similar intellectual or commercial right (in each case whether or not registered or registrable) and registrations of and applications to register any of them.
  35. Limitation Of Liability. The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the extent permitted by law, SIX will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website. SIX makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
  36. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of SIX for death or personal injury as a result of the negligence of SIX or that of its employees or agents.
  37. Indemnity. You agree to indemnify and hold SIX and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against SIX arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
  38. Severability. In the event that any provision of this Agreement is declared by any judicial or other competent authority to be void, voidable, illegal or otherwise unenforceable or indications of the same are received by either you or us from any relevant competent authority, we shall amend that provision in such reasonable manner as achieves the intention of the parties without illegality or, at our discretion, such provision may be severed from this Agreement and the remaining provisions of this Agreement shall remain in full force and effect.
  39. Applicable Law and Dispute. This Agreement and all matters arising from it are governed by and construed in accordance with the laws of Canada whose courts shall have exclusive jurisdiction over all disputes arising in connection with this Agreement and the place of performance of this Agreement is agreed by you to be Canada.
  40. Headings. Headings are included in this Agreement for convenience only and shall not affect the construction or interpretation of this agreement.
  41. Entire Agreement. These terms and conditions together with any documents expressly referred to in them, contain the entire Agreement between us relating to the subject matter covered and supersede any previous Agreements, arrangements, undertakings or proposals, written or oral: between us in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of these terms and conditions. In agreeing to these terms and conditions, you have not relied on any representation other than those expressly stated in these terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not been made expressly in this Agreement.
